Chapter 1:  Street Protection

 

 

7-101  Altering Streets.  It shall be unlawful for any person to cut, change, alter, or in any way disturb any street, curb or sidewalk, in the Town of New Whiteland, without first obtaining a permit to do so, as hereinafter provided.

 

7-102  Street Alteration Permit.  Any person desiring to cut, change, alter, or in any way disturb any street, curb or sidewalk, shall file with the building commissioner his application for a permit in which he sets out the following information:

            a.  The purpose for the proposed alteration;

            b.  The exact specifications of the proposed alteration including locations, size, description, and the time at which the alteration is proposed to be:

            c.  A showing that the applicant is the owner of real estate adjoining the street, curb, or sidewalk on which the alteration is proposed to be made;

            d.  The exact specifications to repair or replace such alteration as he may be permitted to make with materials of the same type and character as the said street, curb, or sidewalk.

 

 

7-103  Permit Approval.  Upon the filing of the application and the payment of a $5.00 filing fee, the building commissioner shall inspect the street, curb, or sidewalk, and if he is satisfied that the reason given by the applicant is a good, sufficient and valid reason for the development, enjoyment, or use of the applicant’s adjoining property, and that the applicant is financially responsible, the building commissioner shall issue a permit allowing the alteration.

 

7-104  Time Limit.  Work contemplated by a alteration permit shall be commenced with ten days of the issuance of the permit and completed within thirty days of the issuance of the permit.  Otherwise, the permit shall be null and void.

 

7-105  Final Inspection.  The building commissioner shall inspect the work at its completion and issue a certificate of completion if he is satisfied that the street, curb, or sidewalk has been repaired or replaced in as good a condition as it was prior to the work, in conformance with the applicant’s warranty.

 

7-106  Penalty.  Any person who cuts, changes, alters or in any way disturbs any street, curb, or sidewalk, without first obtaining a permit under this chapter, or who, having secured a permit under this chapter, fails or reuses to complete the work to the satisfaction of the building commissioner shall be fined a sum of $250.00 plus any court costs, attorney fees  and cost of repairs to the street, curb or sidewalk.

 

 

Chapter 2: Truck Traffic

 

 

7-201  Truck Traffic Prohibited.  It is unlawful for any person to drive or park a truck with a gross registered vehicle weight of more than 11,000 pounds on any street in the Town of New Whiteland.  Exceptions are:  Whiteland Road, Sawmill Road, Tracy Road and County Road 25 West.  Trucks may make local deliveries or render services to the residents of the town.  A truck is defined in Indiana Code 9-12-2-188.

7-202   Penalty:  Any person violating any provision of this chapter shall be fined one-hundred dollars ($100) plus court costs per occurrence.

 

Chapter 3:  Parking and Street Usage Prohibitions

 

7-301   Parking Prohibited:  A person may not stop, stand, or park a vehicle, except when necessary to avoid conflict with other traffic or to avoid conflict with law or the directions of a police officer or traffic control device, in any of the following places.  Any portion of the vehicle being within the areas indicated is a violation:

               a.  On a sidewalk

               b.  In front of a public or private driveway.

               c.  Within an intersection.

               d.  Within fifteen (15) feet of a fire hydrant.

               e.  On a crosswalk.

               f.  Within twenty (20) feet of a crosswalk at an intersection

               g.  Within thirty (30) feet upon the approach to any flashing beacon, stop sign, or traffic control signal located at the side of a roadway.

               h.  Between a safety zone and the adjacent curb or within thirty (30) feet of points on the curb immediately opposite the ends of a safety zone, unless the traffic authority indicates a different length by signs or markings.

               i.  Within fifty (50) feet of the nearest rail of a railroad crossing.

               j.  Within twenty (20) feet of the driveway entrance to a fire station and, on the side of a street opposite the entrance to a fire station, with seventy-five (75) feet of the entrance when properly sign posted.

               k.  Alongside or opposite a street excavation or obstruction if stopping, standing, or parking would obstruct traffic.

l.  On the roadway side of a vehicle stopped or parked at the edge or curb of a street.

m.  Upon a bridge or other elevated structure upon a roadway.

n.  At any place where official signs prohibit stopping, standing or parking.

o.  Adjacent to a yellow curb.

p.   A person may not stop, stand, or park a vehicle in a fire lane.  The fire lane must  be marked as required in Indiana Code 9-21-16-5.5.

q.  On any grassed or seeded town property not intended for parking. 

 r.  The grassy median between the sidewalk and street.

 

7-302  Street Parking.  A vehicle stopped or parked upon a roadway where there is an adjacent curb must be stopped or parked with the passenger side wheels of the vehicle parallel with and within twelve (12) inches of the right-hand curb.

 

7-303  Vehicle Towed at Owners Expense.  Any vehicle found in violation of this chapter may be towed at the owner’s expense if the officer at the scene determines the vehicle is creating an immediate safety or security problem where it is stopped, standing or parked.

 

7-304   Erection of Signs.  The Town Council may place permanent or temporary signs restricting the stopping, standing or parking of vehicles on any street where stopping, standing or parking may be dangerous to pedestrian traffic or would unduly interfere with vehicular traffic.  Persons not complying with any posted official signs are guilty of violating 7-301(n) of this chapter.

 

7-305   Handicapped Parking.  It is unlawful for any vehicle to park in an area marked “Handicapped Parking” unless displaying an authorized handicapped window hanger or handicapped license plate issued by the Indiana Bureau of Motor Vehicles.

 

7-306  Streets for Vehicular Traffic Only.  All streets are for vehicular traffic only. No sports equipment, children’s toys or construction materials may be in the street.  Playing sports or other games in the street is unlawful.

 

7-307  Maximum Parking Time.  Unless otherwise designated by official sign, three days is the maximum length of time a vehicle may be parked on any street or parking area within the town.  At places where a shorter parking time is designated, the maximum parking time shall be as designated on the sign.

 

7-308 Stopping, Standing or Parking in Town Park  Prohibited when Closed.  It is unlawful for any person to stop, stand or park a vehicle within the boundaries of any town park during the hours that the park is closed to the public.

 

7-309 Overnight Parking Prohibited.  It is unlawful for any person to park a motor vehicle or trailer on any roadway between the hours of 2:00 A.M. and 5:00 A.M., except vehicles being used in an emergency situation.  It is the vehicle owner’s responsibility to prove that an emergency existed at the time of the violation.

 

 7-310  Penalty.  Any person violating paragraphs 7-301, 7-302, 7-303, 7-304, 7-305 or 7-306 of this chapter shall be fined a sum of $25.00 for the first offense and $50.00 for each subsequent offense.  Any person violating paragraph 7-307 will be fined a sum of $10.00 per occurrence.

 

Chapter Four – Speed Limit

 

7-401  Speed Limit.  The speed limit on streets within the Town of New Whiteland is 30 miles-per-hour, unless otherwise posted.

 

7-402  School Zone Speed Limit.  The speed for posted school zones within the Town of New Whiteland is 20 miles-per-hour.

 

7-402  Park Speed Limit.   The speed limit for park streets is 15 miles-per-hour.

 

7-403  Temporary Speed Limits:  The town marshal or street department director may

temporarily lower speed limits to meet emergency road conditions or other situations.

 

7-405  PenaltyAny person disregarding speed limits shall be fined a sum not exceeding one hundred ($100.00) dollars plus court costs.

 

Chapter 5 – Temporary Signs

 

7-501 Temporary Signs.  The following temporary signs shall be permitted within any district within the Town of New Whiteland and shall be required to have a permit unless otherwise specified.  A temporary sign permitted under this section may be displayed for a time period not to exceed 60 days in a 180 day period unless otherwise specified.  Temporary signs that obstruct the flow or sight pattern of vehicular traffic on any established right-of-way shall be prohibited.

 

a.  For Sale” or “For Rent”.  One (1) "For Sale" or "For Rent" sign, not more than twelve (12) square feet in area, for each dwelling unit, garage, or other quarters, buildings, structures, or land, shall be permitted.  Such a sign is not subject to the generally applicable display time limitations of this Section.  No permit is required.

 

b.   Agricultural Products.  One (1) sign, not more than twenty (20) square feet in area, pertaining to the sale of agricultural products raised on the premises shall be permitted.

 

c.  Public Interest Event.  For an event of public interest such as a county fair, or church event, one (1) sign, not over twenty-four (24) square feet in area and located upon the site of the event shall be permitted, as well as off-site signs advertising such event, not more than twelve (12) square feet in area, and not more than one such sign per parcel. Such signs shall not be erected more than thirty (30) days before the event in question and shall be removed immediately after such event. Also, directional signs shall be permitted, not more than three (3) feet in area, showing only a directional arrow and the name of the event of public interest. Such directional signs shall not be erected more than fourteen (14) days before the event in question and shall be removed immediately after the event.  No permit is required for such off-site and directional signs.

 

d.  Construction.  Construction signs which identify the architects, engineers, and contractors of individual buildings, and other individuals or firms involved with such construction, and signs announcing the character of the building enterprise or the purpose for which the building is intended, during the construction period, and limited to a maximum of thirty-two (32) square feet for each firm.  Such signs may not include any advertisement of any product.  The minimum setback shall be ten (10) feet from any street right-of-way.  Such signs shall be confined to the parcel that is the site of building construction and shall be removed within thirty (30) days after the end of construction.  Such a sign is not subject to the generally applicable display time limitations of this Section.

 

e.  Sale of Subdivision Lots.  For real estate development that has been approved in accordance with the Subdivision Control Ordinance, one (1) temporary sign per entrance, not more than thirty-two (32) square feet of face area advertising the sale of property in such subdivision shall be permitted, but only when located on some portion of the subdivision having undeveloped lots being advertised for sale. Such a sign shall be located a minimum distance of ten feet from any street right-of-way.  Such a sign shall not be illuminated.  Such a sign shall be maintained only during such time as there are undeveloped subdivision lots advertised for sale that remain unsold.  Permits for such signs shall be issued for one (1) year periods and may be renewed for additional one (1) year periods to allow time for reasonable display.  Permanent subdivision or project identification signs may be obtained pursuant to Section 7-1401(b).  Such a sign is not subject to the generally applicable display time limitations of this Section.

 

f.  Banners and Pennants.  Banners, flags, streamers, and pennants shall be permitted so long as they are at least ten (10) feet from any street right-of-way located so as not to obstruct vision or otherwise create a hazard to traffic.  No permit shall be required if the banners, flags, streamers, or pennants are being used in a residential district for residential purposes.

 

g.  Window Signs.  Window signs are permitted, provided such signs conform to the construction, illumination, and safety regulations of this Ordinance.  A “window sign” shall mean a sign posted, painted, placed, or affixed in or on a window exposed to public view, or an interior sign that faces a window exposed to public view that is located within three feet of the window.  No permit is required.

 

h.  Portable Signs.  In residential districts, one (1) portable sign of a non-commercial nature may be permitted for a time period not to exceed 72 hours in any seven (7) day period.  No permit is required for portable signs in a residential district. In non-residential districts, one (1) portable sign may be permitted for a time period not to exceed sixty (60) days in any one hundred eighty (180)-day period.  Renewal permits may be obtained so long as there are no zoning violations relative to said permit.  A “portable sign” shall be defined as any sign that is not permanently attached to the ground and that is designed to be transported and used from place to place, including, but not limited to, signs transported by means of wheels; signs attached to A- or T-frames; yard card signs; menu and sandwich board signs; balloons used as signs; umbrellas used for advertising; and signs attached to or painted on vehicles parked and visible from the public right-of-way, unless said vehicle is used for transportation in the normal day-to-day operation of the business.  Such a portable sign shall:

                        1.  Be located not less than ten (10) feet from any public right-of-way;

            2. Not obstruct the flow or sight pattern of vehicular traffic on any established right-of-way;

            3.  Be located not less than ten (10) feet from an adjoining residential lot;

            4.  Have a face not exceeding thirty-two (32) square feet;

            5.  Meet the illumination requirements as set forth in Section 7-1400(g); and

            6.  Be approved by the Building Inspector.

i.  Garage Sale Signs.  Signs advertising the sale of miscellaneous household items for the purpose of a residential garage or yard sale shall not exceed four (4) square feet in area.  Such signs may be erected on the premises one (1) week in advance of the sale and shall be removed within forty-eight (48) hours after the sale.  If the garage sale is a coordinated neighborhood garage sale, one (1) temporary sign for each entrance of the neighborhood, not more than twenty (20) square feet in area, shall be permitted. No permit is required.

j.  Political Campaign Signs.  Political campaign signs announcing candidates seeking public political office shall be confined within private property and not within the street right-of-way, shall be permitted no more than forty-five (45) days prior to the scheduled election, and shall be removed within fourteen (14) days after election for which they were made.  A permit shall not be required for such signs.

 

k.  Model Home Signs.  For lots containing a model home, one (1) sign identifying the model home, not exceeding sixteen (16) square feet in total surface area and four (4) feet in height located on the street frontage of the lot containing the model home.  Such a sign shall not be located on or within any public right-of-way or located on the model home building, and shall be removed immediately after the building no longer serves as a model home.  A permit shall not be required.  Such a sign is not subject to the generally applicable display time limitations of this Section.

 

7-502  Penalty.   Any person violating paragraphs of this chapter shall be fined a sum of $25.00 for the first offense and $50.00 for each subsequent offense.

Chapter 8:  Snow and Winter Weather Emergency.

 

7-801  Snow and Winter Weather Emergency.  Based upon winter weather and snow warnings issued by the National Weather Service the town marshal in coordination with the superintendent of public works may declare a snow emergency for the removal of snow.  This allows the town to best utilize its limited resources to clear main thoroughfares for vehicular traffic and provide other emergency equipment a means to get through the town.

7-803   Snow and Winter Weather Emergency Street Parkingtc \l2 "7-602 Snow Emergency.  When a snow emergency has been declared it shall be unlawful to park a motor vehicle on any of the streets which constitute emergency snow removal route.

 

7-804   Penaltytc \l2 "7-603 Penalty.  Any motor vehicle parked in violation of 7-803 shall be towed off the street at the owner’s expense and the vehicle owner shall be fined a sum of $25.00 plus court cost.
