Chapter 1: Board of Trustees
2-101 Length of Time. Trustees elected from Wards 2 and 5 shall be elected for a term of two (2) years beginning January 1, 1979 and the remainder of the Trustees of the Town of New Whiteland shall be elected for the term of four (4) years. No terms may be for a period of less than two (2) years or more than (4) years. Their successors shall serve for four (4) years.
2-102 Date of Election. On the first Tuesday after the first Monday in November 1979, the Trustees of the Town Board shall be elected as provided in 2-101, to take office January 1, 1980.
2-103 Date of Election. All offices of the Town of New Whiteland shall be nominated at the primary election and elected at the general election by the vote of all voters eligible to vote in the general election under the laws and constitution of the State of Indiana.
Chapter 2: Ward Boundaries
2-201 The First Ward District: Is comprised of all that area located within the Town of New Whiteland as follows: Beginning at a point in the middle of the intersection of Sawmill Road and Whiteland Road and continuing east along Whiteland Road to a point where the east boundary of the Town intersects with Whiteland Road, including the north side of Whiteland Road; thence north along the east boundary line of the Town to a point where the east boundary line meets with East Grassy Creek just north of where the east boundary line of the Town intersects with Westbrook Drive; thence east along the east boundary line continuing to a point where the east boundary line intersects with U.S. Highway 31; thence south along U. S. Highway 31 to a point where the boundary line of the Town intersects with Tracy South Drive; thence east along Tracy South Drive to the intersection of Tracy Street; thence north along Tracy Street to a point where the east boundary line of the Town intersects with an east-west boundary line just north of Tracy North Drive and continues to the west until the east boundary line of the Town intersects with U. S. Highway 31; thence north along U. S. Highway 31 to the intersection of Parkview Drive; thence west along Parkview Drive to the intersection of Sweetbriar Avenue; thence north along Sweetbriar Avenue to the intersection of Hollybrook Drive; thence west along Hollybrook Drive to the intersection of Delbrook Drive; thence southeasterly along Delbrook Drive to the intersection of Parkview Drive; thence west along Parkview Drive to the intersection of Melrose Drive; thence north along Melrose Drive to the intersection of Hollybrook Drive; thence west along Hollybrook Drive to the intersection of Sawmill Road; thence south along the Town limits on Sawmill Road to the place of beginning at the intersection of Sawmill Road and Whiteland Road. Also, that area within the Town of New Whiteland on which the sewer treatment plant is located.
2-202 The Second Ward District: Is comprised of all that area located within the Town of New Whiteland as follows: Beginning at a point in the middle of the intersection of Sawmill Road and County Road 600 N and continuing south along Sawmill Road to the intersection of Southlane Drive; thence east along Southlane Drive to the intersection of Princeton; thence south along Princeton to the intersection of Parkview Drive; thence west along Parkview Drive to the intersection of Melrose Drive; thence north along Melrose Drive to the intersection of Hollybrook Drive; thence west along Hollybrook Drive to the intersection of Sawmill Road; thence south along Sawmill to the west boundary line of the Town; thence west along the west boundary line of the Town to the intersection of Grassy Creek; thence south on Grassy Creek to the west boundary line of the Town; thence continuing west on the west boundary line of the Town to the intersection of N 75 W; thence north along N 75 W to the west boundary line of the Town; thence continuing east on the west boundary line of the Town to the intersection of Grassy Greek; thence north along Grassy Creek to the intersection of County Road 600 N; thence east along County Road 600 N to the intersection of the west boundary line of the Town; thence following the west boundary line of the Town to the south, then to the east, and to the north until it intersects with County Road 600 N; thence west along County Road 600 N to the intersection of the west boundary line of the Town; thence following the west boundary line of the Town to the north, then to the east, then to the south to the intersection of County Road 600 N; thence following the west boundary line of the Town as it continues to the west, then to the south, then to the east, and to the north until it intersects again with County Road 600 N; thence east to the place of beginning at the intersection of Sawmill Road and County Road 600 N.
2-203 The Third Ward District: Is comprised of all that area located within the Town of New Whiteland as follows: Beginning at a point in the middle of the intersection of Sawmill Road and County Road 600 N and continuing east to the intersection of Princeton; thence south along Princeton to the intersection of Northlane Drive; thence east along Northlane Drive to the intersection of Middle Drive; thence south along Middle Drive to the intersection of Southlane Drive; thence east along Southlane Drive to the intersection of Sweetbriar Avenue; thence south along Sweetbriar Avenue to the intersection of Hollybrook Drive; thence west along Hollybrook Drive to the intersection of Delbrook Drive; thence southeast along Delbrook Drive to the intersection of Parkview Drive; thence west along Parkview Drive to the intersection of Princeton; thence north along Princeton to the intersection of Southlane Drive; thence west along Southlane Drive to the intersection of Sawmill Road; thence north along Sawmill Road to the place of beginning at the intersection of Sawmill Road and County Road 600 N.
2-204 The Fourth Ward District: Is comprised of all that area located within the Town of New Whiteland as follows: Beginning at a point at the intersection of County Road 600 N and Ashland Avenue continuing north along Ashland Avenue to the intersection of Brentwood Lane; thence east along Brentwood Lane to the intersection of Warwick Drive; thence north and west along Warwick Drive to the intersection of the north boundary line of the Town of New Whiteland; thence east along the north boundary line of the Town to the east boundary line of the Town of New Whiteland at the Conrail Railroad; thence south along the east boundary line of the Town at the Conrail Railroad to the intersection of County Road 600 N; thence west along County Road 600 N to the intersection of U. S. Highway 31 South; thence south along U. S. Highway 31 South to the intersection of Parkview Drive; thence west along Parkview Drive to the intersection of Sweetbriar Avenue; thence north along Sweetbriar Avenue to the intersection of Southlane Drive; thence west along Southlane Drive to the intersection of Middle Drive; thence north along Middle Drive to the intersection of Northlane Drive; thence west along Northlane Drive to the intersection of Princeton; thence north along Princeton to the intersection of County Road 600 N; thence east along County Road 600 N to the place of beginning at the intersection of County Road 600 N and Ashland Avenue.
2-205 The Fifth Ward District: Is comprised of all that area located within the Town of New Whiteland as follows: Beginning at a point at the intersection of County Road 600 N and Ashland Avenue continuing north along Ashland Avenue to the intersection of Brentwood Lane; thence east along Brentwood Lane to the intersection of Warwick Drive; thence north and west along Warwick Drive to the intersection of the north boundary line of the Town of New Whiteland; thence west along the north boundary line of the Town to the intersection of County Road 25 W; thence south along County Road 25 West following the west boundary line of the Town as it continues south, then east, then south, then west, then south, then east, and then south to the intersection of County Road 600 N; thence east along County Road 600 N to the place of beginning at the intersection of County Road 600 N and Ashland Avenue.
2-206 The Council Ward District Boundaries: established in Sections 2-201 through 2-205 are graphically depicted on the attached map entitled “Map of New Whiteland Council Ward Districts Established in 2002.” In the event of a discrepancy between the boundary lines drawn on the Map and the boundary lines described in Sections 2-201 through 2-205, the boundary lines drawn on the map shall control.
Chapter 3: Employees
2-301 Payroll. Employees of the Town of New Whiteland will be paid on a bi-weekly basis, with twenty-six pay periods during the calendar year.
2-401 Creation of CCI Fund. Pursuant to I.C. 6-7-31.1, there is hereby created a special fund known as the Cumulative Capital Improvement Fund of New Whiteland, into which the cigarette taxes allotted to New Whiteland, pursuant to 6-7-30.1 shall be deposited
2-402 Use of CCI Fund. All monies deposited into the Cumulative Capital Improvement Fund shall be appropriated and used solely for capital improvements as defined in 2-503 and none of said monies shall revert to the general fund.
2-403 Capital Improvements. The term “capital improvements” means the construction or improvement of any property owned by the Town of New Whiteland including but not limited to streets, thoroughfares and sewers, and the retirement of general obligation bonds issued by the Town, the proceeds of which are used for capital improvements. The term “capital improvements” shall not include salaries of any public officials or employees except to the extent that any are directly chargeable to a capital improvement.
Chapter 5: Rainy Day Fund.
2-501 Creation of Rainy Day Fund. There is hereby established a “Rainy Day Fund” which shall be funded in the manner and be used for the purposes specified within this Chapter.
2-502 Purposes of the Rainy Day Fund. The funds on deposit in the Rainy Day Fund may be used for the operation of the Town and its various departments, when the Town does not have sufficient levies or funds to pay such costs, including, but not limited to, salaries and wages, costs of services, supplies, equipment, capital improvements, repairs, and similar expenditures.
2-503 Sources of Funding. The source of the funds of the Rainy Day Fund may be any one or more of the following:
a. A transfer of unused and unencumbered funds of dormant fund balances pursuant to IC 36-1-8-5.
b. A transfer from a budgeted appropriation of any fund of the Town, except for any fund dedicated to the payment of a capital lease or debt service.
c. A transfer from a duly approved additional appropriation of any fund of the Town, except for any fund dedicated to the payment of a capital lease or debt service.
d. A transfer of funds derived from the County Adjusted Gross Income Tax (CAGIT), pursuant to IC 6-3.5-1.1-21.1, or the County Option Income Tax (COIT), pursuant to IC 6-3.5-6-17.3 or IC 6-3.5-7-17.3.
e. Earnings resulting from the investment of Town funds pursuant to IC 5-13.
f. Funds gifted to the Town and specified by the donor to be credited to the Rainy Day Fund or used for the purposes of the Rainy Day Fund, or gifted funds unrestricted by the donor and then specified by the Town’s fiscal body to be credited to the Rainy Day Fund.
2-504 Transfers to Rainy Day Fund. During the period January 1 through February 28 ADVANCE \u3ADVANCE \d3of each year, the Town Council shall determine the amount, if any, of funds to be transferred to the Rainy Day Fund and take action to transfer such funds. In any fiscal year, the Town may transfer to the Rainy Day Fund not more than ten percent (10%) of the Town’s annual budget for that fiscal year, as adopted under IC 6-1.1-17.
2-505 Appropriations. The Town Council of the Town of New Whiteland may authorize the expenditure of funds from the Rainy Day Fund by appropriations made in the same manner as other funds are appropriated that receive tax monies, upon making a finding that the proposed use of the Rainy Day Funds is consistent with the intent of the Rainy Day Fund.
